JD Estate Sales (“JD Estate Sales,” “we,” “us,” or “our”) is an estate sale, auction, and liquidation company operating in California. We run on-site estate sales, live and online auctions, tag sales, and related services for estates, families, fiduciaries, and other clients.

This Policy applies to personal information we collect online and offline, including at sale locations, by phone or email, through bidder registration, and via third-party auction or payment platforms we use. It does not apply to websites or services we do not control (for example, an independent bidding platform’s own site), which have their own privacy notices.

2. Personal Information We Collect

“Personal information” means information that identifies, relates to, or could reasonably be linked with you or your household. Depending on how you interact with us, we may collect the following categories:

We do not knowingly collect personal information from children under 16. Our sales and website are directed to adults.

  • Service providers and platforms — online auction hosts, payment processors, email or SMS tools, shipping companies, and website hosts.

  • Referrals — other buyers, dealers, or professionals who introduce you.

3. How We Use Personal Information

We use personal information to:

  • Operate estate sales, auctions, and liquidations, including bidder registration, paddle assignment, invoicing, payment, tax collection, and load-out;
  • Verify identity, prevent fraud, theft, and collusive or bad-faith bidding, and enforce our Terms of Service and house rules;
  • Communicate about upcoming sales, invoices, pickup deadlines, and customer service (including email, phone, and text if you provide a number);
  • Maintain consignment, settlement, and accounting records for clients and for tax and legal compliance;
  • Improve our website, catalogs, and operations;
  • Comply with law, respond to lawful requests, and protect the rights, safety, and property of JD Estate Sales, our clients, staff, and attendees;
  • Send marketing about future sales if you have not opted out (you may unsubscribe at any time).

We retain information only as long as reasonably necessary for these purposes, including typical business, tax, and dispute-resolution periods (often several years for invoices and consignment files), unless a longer period is required by law.

4. How We Disclose Personal Information

We may disclose personal information to:

  • Service providers / contractors who process it only for us (payment processors, auction software, email/SMS vendors, accountants, IT and website hosts, insurers, and professional advisors);
  • The estate, seller, or their attorneys/fiduciaries as needed to settle a sale (for example, buyer invoice totals or bidder defaults);
  • Shippers, movers, and locksmiths you or we engage to complete a transaction;
  • Other platforms when you bid online — those platforms receive the data you submit to them under their policies;
  • Authorities when required by law, court order, or to report suspected theft or fraud;
  • Successors in connection with a merger, sale of assets, or similar transaction, subject to appropriate confidentiality.

We do not sell bidder or customer lists to data brokers. We do not sell personal information for money. We also do not “share” personal information for cross-context behavioral advertising as those terms are defined in the CCPA/CPRA, unless we later use advertising cookies that qualify — in which case we will update this Policy and provide a “Do Not Sell or Share My Personal Information” link. If our website uses analytics or advertising cookies, those third parties may receive limited identifiers and internet activity; you can control many cookies through your browser and any cookie banner we display.

We do not use or disclose sensitive personal information for purposes other than those permitted by CPRA regulations (for example, performing services you request, security, and short-term use).

5. Cookies and Similar Technologies

Our website may use cookies, pixels, and local storage to keep the site working (session and security cookies), remember preferences, understand traffic, and measure whether sale announcements are opened. You can refuse non-essential cookies in your browser settings. Blocking cookies may affect site features. Third-party auction or payment pages you leave our site to use will set their own cookies.

6. Email, Texts, and Marketing Choices

Transactional messages (invoices, pickup reminders, sale-day changes) are part of doing business with us. For promotional emails about upcoming sales, use the unsubscribe link or email us at the address below. For SMS, reply STOP if we have your consent to text you. We honor Global Privacy Control (GPC) signals as opt-out of sale/share to the extent we engage in activity those signals cover.

7. Your California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the right to:

  • Know / access the categories and specific pieces of personal information we have collected about you, the categories of sources, business purposes, and categories of third parties to whom we disclose it;
  • Delete personal information we collected from you, subject to legal exceptions (for example, completing a transaction, detecting security incidents, or complying with a tax or legal obligation);
  • Correct inaccurate personal information;
  • Opt out of sale or sharing of personal information, if we ever sell or share it as defined by law;
  • Limit use of sensitive personal information to permitted purposes (our current use is already limited);
  • Non-discrimination for exercising these rights. We will not deny goods or services or charge a different price solely because you exercised a CCPA right, except as permitted for a bona fide loyalty or similar program we may offer.

California’s “Shine the Light” law (Civil Code § 1798.83) also allows certain customers to request information about personal information disclosed to third parties for those parties’ direct marketing. We do not disclose personal information to third parties for their own direct marketing.

We will verify your identity using information we already have (for example, matching email and a recent invoice). For requests for specific pieces of information, we may ask for additional verification. You may use an authorized agent; we will require proof of authorization and may still verify you directly.

We will respond within 45 days, or notify you if we need up to an additional 45 days as permitted by law. If we deny a request in whole or in part, we will explain the reason.

8. Security

We use reasonable administrative, technical, and physical safeguards appropriate to a small professional services business — for example, limited staff access to bidder and client files, secure payment processing through reputable processors, and locked storage of paper registration and consignment records. No method of transmission or storage is completely secure. Please use unique passwords on any online bidder accounts and notify us promptly if you believe your information was compromised.

On-site sales take place in private homes. Do not leave IDs, wallets, or phones unattended. We are not responsible for other attendees’ conduct.

9. Photographs of Merchandise and Premises

We photograph and sometimes video interiors and lots for catalogs, social media, and our website. If you do not want to appear in marketing images, tell a staff member on site. We will reasonably avoid featuring you, but we cannot guarantee you will not appear incidentally in wide shots of a public sale.

10. Clients, Estates, and Confidential Household Information

When we work inside a home or review an estate’s papers, we may see sensitive household information (financial documents, medical items, correspondence). We train staff to treat that material as confidential, to inventory only what is needed for the sale, and not to use or disclose it except to perform the engagement, protect the property, or comply with law. Documents not offered for sale are handled according to the client’s written instructions (shred, return, or leave in place).

11. Third-Party Sites and Platforms

Links to auction platforms, maps, payment pages, or social networks are not covered by this Policy. Review those parties’ privacy notices before you register or pay there.

12. Changes to This Policy

We may update this Policy from time to time. The “Effective date” at the top will change when we do. Material changes will be posted on this page. Continued use of the website or our services after an update means you acknowledge the revised Policy.
